Terms & Conditions

These Terms govern your access to and use of the products and services provided by StackedGTM ("StackedGTM", "we", "us"), including the Narrative OS application, diagnostics, reports, and related media (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who you are contracting with

You are entering into this agreement with StackedGTM, the provider of the Service.

2. Eligibility & authority

You must be of legal age to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Account & accuracy

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date.

4. Acceptable use

You agree not to misuse the Service. You will not:

  • Use the Service for unlawful, fraudulent, or deceptive purposes;
  • Send spam or violate the rights of others, including intellectual property rights;
  • Interfere with the security or integrity of the Service (including by introducing malware, probing, scanning, or scraping);
  • Reverse engineer, resell, or redistribute the Service except as expressly permitted;
  • Circumvent any technical limits or usage controls.

5. Intellectual property

StackedGTM retains all right, title, and interest in and to the Service, including all software, documentation, branding, and content we provide. You are granted a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

6. User content

You retain ownership of content you submit to the Service. You grant StackedGTM a limited license to host, process, and display that content solely as needed to provide the Service.

7. Payment & subscription

Our order process is conducted by our online reseller Stripe. Stripe acts as our Merchant of Record for orders where applicable, handling payment, billing, taxes, invoicing, and refunds on our behalf. Buyer-facing payment, billing, tax, cancellation, and refund mechanics are governed by Stripe's terms.

8. Service level

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or that defects will be corrected immediately.

9. Suspension & termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends and we may delete associated data after a reasonable export window.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Diagnostics, reports, and strategic content are for informational purposes and are not a substitute for your own judgment.

11. Limitation of liability

To the fullest extent permitted by law, StackedGTM's aggregate liability arising out of or related to the Service will not exceed the fees you paid to us in the 12 months preceding the claim. We will not be liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Indemnity

You will indemnify StackedGTM against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which StackedGTM is established, without regard to conflict of laws principles.

14. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email.
